General Terms and Conditions
Please read the terms carefully before selling your phone to Mac Store. By selling your phone, you agree to comply with our terms.
We may, at our sole discretion, accept or reject the sale.
Definitions:
“Mac Store” refers to Frederico Costa (NIF: 287 859 690), a Portuguese entity.
“You” refers to the seller of the phone.
“Phone” refers to the item sold by You to Mac Store.
“Terms and Conditions” or “Agreement” refers to these Terms and Conditions.
“Payment” refers to the payment you receive from Mac Store for the phone sold to Mac Store.
“Package” refers to the package sent by You to Mac Store with the phone being sold to Mac Store.
“Bank information” refers to the bank information you provide to Mac Store for payment purposes.
“Almost New Phone” refers to the Almost New Phone described in the list in section 3 of this document.
“Damaged Phone” refers to the Damaged Phone described in the list in section 3 of this document.”
Recyclable Phone” refers to the Recyclable Phone described in the list in section 3 of this document.
1. Acceptance of Terms and Conditions
By filling out the form and agreeing to Mac Store's Terms and Conditions, you are confirming that:
- You are an individual residing in the EU area
- You are the owner of the Device(s) and have every right to sell them and profit from them
- You are of legal age to sell and profit from the device(s). If you are underage, you must obtain the consent of your parents or guardian to sell your device(s) to Mac Store for the estimated amount calculated on our website;
- You have the legal capacity to enter into a binding contract;
- You confirm the legitimacy of your Bank Information. You should note that you are solely responsible for any errors related to the Bank Information you provided to Mac Store.
- You grant Mac Store all rights to inspect the device(s) to identify any missing parts and or damage. This may require Mac Store to physically open the device(s).
2. Terms of Sale
- Estimates are valid for a maximum of 14 days from the submission date. After this period, Mac Store has the right to update the price according to current market price changes.
- When Mac Store receives your package and after payment has been made to you, ownership of the device is immediately transferred to Mac Store.
- You can cancel the sale at any time before sending the phone to Mac Store.
- Any sales request and shipment made on Mac Store's website using a label provided by us is your responsibility until the package has been delivered to Mac Store's Premises.
- You can choose any other carrier at your own expense.
- You are responsible for the contents of the Package and its packaging.
- Mac Store assumes no responsibility if the Package is lost or damaged during transit to Mac Store's Premises.
- Mac Store assumes no responsibility for accessories or packaging (e.g., original Apple box, cables, cases, etc.) included in the package. Mac Store automatically discards them, and it is impossible to retrieve them.
- Should there be any problem with the delivery of the package, Mac Store has the option to initiate an investigation on your behalf directly with the respective carrier and provide you with further information later.
- We will pay for your phone the price shown on our website provided that the device is in the condition you indicated. If the phone is in better condition than indicated, you will receive a higher amount as payment. Payment may also be lower if the phone is in worse condition than you indicated. In the latter case, Mac Store will send you a confirmation email that you must approve in order to proceed with the payment. Otherwise, you may request that the device be returned to you free of charge.
- You have 60 calendar days to respond to Mac Store's confirmation email. After this time, ownership rights of the Phone will be automatically transferred to Mac Store.
- If the Package is not collected after being sent back to you, and is returned to Mac Store's Premises, you are responsible for covering the shipping costs if you request the order to be returned to you.
- Once Payment has been made, you have lost your rights to claim any returns or refunds. You should note that you are solely responsible for any errors related to the bank information you provided.
- By accepting the above clause, Mac Store reserves the right to charge any bank investigation fees if you request an additional verification of transactions made in your account. The fees must be transferred to Mac Store's bank account before Mac Store proceeds with any procedures related to the investigation.
Mac Store occasionally accepts intact unlisted models. In these cases, please contact us by filling out our contact form.
3. Phone Condition
- The price paid for the phone is influenced by the model, memory, and condition of the Phone. Mac Store tests all Phones with industry-leading software.
- Mac Store does not purchase Phones that are:
- water-damaged,
- bent;
- have issues suggestive of motherboard problems;
- have a defective Touch ID;
- have active FMI (Find My iPhone) functionality;
- have non-functional Face ID or True Tone;
- have an irreparable crack in the Home button;
- Phones that were manufactured for Japan, China, or Middle Eastern countries, or Phones that were previously disassembled and reassembled with non-original Apple parts.
- Mac Store does not purchase stolen Phones. We will check the legal status of the Phone in the international CheckMEND database. Phones found to be blacklisted will be automatically returned to you (Exceptions, Section 1).
- The Phone must be a genuine Apple product.
Requirements for an Almost New Phone
- All functionalities of an Almost New Phone must be fully operational.
- The body of the Phone must be intact and not cracked or show signs of use.
- All intact Phones must meet the following criteria:
- The Phone must turn on and off normally.
- The Phone has a scratch-free battery and glass/back cover.
- The Phone must not be water or fire damaged.
- The screen must be intact and fully operational, and must not show cracks, white spots, darker areas, or any other color blemishes.
- The Phone must not be bent.
- The Phone must include all original parts.
- The Phone's biometric sensor (Touch ID / Face ID) must work.
- The glass screen, frame, and touchscreen sensor are intact.
- The screen frame must match the original, for example: a model of a certain color must have a screen that matches that same color.
- If one or more of these requirements are not met, the updated price offer may decrease from the original price offer.
Definition of a Damaged Phone
The screen glass and/or touchscreen are broken, and the screen has LCD or pixel defects. In addition, the Phone may also have other defects from the following list:
- A damaged battery (the Phone does not turn on).
- If the battery has been replaced by a third party on XR, XS models and above, the Phone will be automatically classified as “Recyclable”.
- The Phone screen is loose.
- There is no sound from the speakers or when an AUX plug is connected to the Phone.
- One or more microphones do not work.
- The Home, volume, mute, or power button do not work or malfunction.
- The front camera does not work/malfunctions.
- The rear camera does not work or malfunctions (focusing issues, shaky image, or visible dark spots on the rear lens).
- The rear or front camera lens is cracked.
- The proximity sensor does not work.
- The back glass and/or frame are cracked.
- There is a software error that appears on the “Hello” screen (iTunes does not connect to the Phone or reset to factory settings).
- The charging port is defective (the Phone does not charge or the port is loose/malformed).
- The Phone does not recognize SIM cards.
- Vibration does not work.
- The Phone has missing parts.
- Force touch functionality does not work.
- The camera flash does not work.
- The Phone can charge but does not connect to a computer (“No data” fault).
- If the Phone's replacement screen does not meet Mac Store standards or is not original.
Attention! Even if the Phone is completely broken, it may have value if the motherboard is not damaged.
Definition of a Recyclable Phone
By default, a Phone that cannot be classified into any of the above condition categories will fall into the Recyclable category. If the Phone is not repairable, Mac Store can send it back free of charge or give you the option to accept €5 to recycle the Phone with Mac Store.
More specifically, if the Phone has one or more of the following faults, it will be automatically classified as Recyclable:
- The Phone has issues suggesting motherboard problems:
- The Phone has a “CallFail” message,
- The Phone does not connect to the network (Wi-Fi).
- The Phone does not record audio files in any format.
- The “No service” message on the cellular indicator appears permanently.
- The Phone has non-functional GPS /Compass (“Gyro”).
- If the battery is replaced by a third party on XR, XS models and above and shows the “Important Battery Message”.
- The Phone has suffered water damage.
- The Phone is bent.
- The Phone has a non-functional Touch ID, Face ID, or True Tone.
- Bluetooth does not work.
- For iPhone 11 models or higher, if the screen is not original and shows the “Important Display Message”.
- Wireless charging does not work.
- The Home button is cracked.
- The Phone is carrier-locked. Carrier-locked Phones cannot be purchased by Mac Store. Mac Store can offer €5 to recycle them. Mac Store cannot act on your behalf and contact the carrier to unlock the Phone, due to Mac Store's GDPR agreement.
- The Phone was manufactured for Japan, China, or Middle Eastern countries.
- The Phone is an iPhone 7 Model A1660.
Other categories
For iPhone 6s Plus, SE (2016), 6s models and below, Mac Store offers no compensation, regardless of the Phone's condition.
Exceptions
- Blacklisted Phones
If the Phone has a record indicating it was lost or stolen, or Mac Store is aware of any other issues related to its ownership (e.g., if it is blacklisted), Mac Store will notify you by email and quarantine the Phone for an initial period of 14 days (“The Quarantine Period”). Payment for the Phone will be withheld by Mac Store until the CheckMEND record no longer shows the Phone as stolen or lost.
In these circumstances, you will be required to contact the seller, store, carrier, or third party who sold you the Phone to prove that you are the legitimate owner of the Phone, have the lost or stolen records associated with it removed within the Quarantine Period, and resolve any other issues related to its ownership.
If, during the Quarantine Period, the Phone is removed from the CheckMEND database and any other issues related to ownership have been resolved, your sale will be processed and paid normally.
However, if the Phone is not removed from the CheckMEND database within the Quarantine Period, Mac Store is legally obliged to retain the Mobile Phone or device, hand it over to the police or other law enforcement authorities, or dispose of it, and by entering into this agreement, you expressly consent to this action. You will not receive any Payment if such measures are taken.
Legislation states that Mac Store cannot, under any circumstances, return or pay for a Phone that is lost, stolen, or recorded as such, unless endorsed in writing by CheckMEND, and upon such, you agree to pay any return costs involved.
If you have received Payment from Mac Store for a Phone, regarding which Mac Store subsequently becomes aware of an ownership-related issue, you agree to immediately reimburse Mac Store in full, within 3 business days of a written request from Mac Store, for any payment pending investigation by Mac Store or any law enforcement authority regarding the Phone's ownership.
If Mac Store, at any time, becomes aware of any issues related to the Phone's ownership, you agree to cooperate fully with Mac Store to resolve the issues. You may also be contacted by the police and/or other law enforcement authorities.
Mac Store may disclose your data to the police or other authorized bodies (such as, but not limited to, network operators and insurance companies) for the purposes of investigating or preventing a crime. By entering into this agreement, you agree that Mac Store may provide data to the police or other authorized bodies for the purposes of crime prevention and detection, arrest and prosecution of offenders, or for the recovery of stolen goods.
- MDM (Mobile Device Management) locked phones
MDM-locked phones refer to the condition of a mobile device that is company-owned and is monitored and managed by corporate security software, typically a company. MDM-locked devices cannot be purchased by Mac Store under any circumstances, as you do not have the rights to sell or profit from the device. The device will be sent directly to you at Mac Store's expense. However, if there is reasonable doubt that you were aware of the Phone's condition when submitting the order, Mac Store reserves the right to charge you for the delivery costs.
4. Payment
- You must fill in all the necessary information on Mac Store's online sales form to make the Payment within the promised timeframe.
- Mac Store aims to process Payment within 1 to 4 days after the Phone arrives at Mac Store's Premises. However, Mac Store's verification process may be affected by unexpected circumstances that may delay the process for a few days.
- Once payment is redirected, the seller has lost their rights to claim any claim relating to the ownership of the device. Any refunds or additional compensation must be addressed by contacting Mac Store's Customer Support. Note that Mac Store has the right to refuse refunds or compensation requests later.
- You must promptly inform Mac Store's Customer Support of any irregularities related to the Payment:
- If Mac Store mistakenly pays you more than agreed, you will have to return the difference from the original amount within 7 days after the Payment is made.
- Mac Store has the right to reclaim overpaid amounts and take further legal action if the situation so requires, should the amount not be transferred back to Mac Store's account within the agreed period.
